According to the Congressional Research Service Report RS21984: Internet Gambling: Overview of Issues, there are a number of reasons for the federal government to pursue prosecution of illegal Internet gambling.

The United States has filed a criminal case against K23 Group Financial Services, an Internet poker operator. In addition, the U.S. Marshal Service has seized $3.2 million from the company’s subsidiary, Discovery Communications.

Federal and state officials have expressed concerns that Internet gambling can bring illegal gambling into their jurisdictions. Among the problems is that some states already have laws prohibiting such activities. For example, New Jersey recently passed a bill that abets online gambling. But this is only a small part of the issue. Regardless of the outcome of the case, the fact that it is a crime to participate in a game that is prohibited by state law makes enforcement more difficult.

Another problem with the UIGEA is the fact that it is only one part of the problem. The other part is the Travel Act, which requires that players who engage in gambling while traveling outside of their home state must register with the appropriate state authorities. Those who use interstate facilities to engage in illegal activities must pay a fine. Since this is a criminal offense, the government can pursue a fine that exceeds the value of any winnings. Moreover, the travel element of the offense has a chilling effect on enforcement policies that apply to players who use state-run facilities.

There are also issues related to the ability of state regulators to monitor and regulate the internet. Some argue that the commercial nature of the gambling industry is a sufficient basis for congressional action. On the other hand, others claim that due process arguments have been severely weakened when it comes to financial transactions in the U.S. Consequently, the Federal Communications Commission has the authority to restrict or even discontinue providing or leasing facilities.
